FTX still alive?

Dear Thriley,

Do you really think that FTX will survive and start trading as an exchange again? Of course you don't! Nobody does, least of all Sam Bankman-Fried! So why not state the obvious? It is dead, defunct, "Was" is perfectly appropriate. You're probably thinking something like "Yes, but it needs to be officially ruled on in court." No, bankruptcy proceedings like this one can take forever. I'll guess 1 year minimum while everybody fights over any perceived assets that are left. In the meantime, we'd be giving our readers a false view that there is some hope left that it can be revived. I just can't be. Let me know what type of evidence you'd need to accept "was" instead of "is", but if you say "The Ch.11 proceeding needs to be closed" then you'd be saying that we are required to mislead our readers for a year. That can't be the proper thing to do, can it? I'll ping @David Gerard: who knows quite a bit about FTX to see what he thinks.

Sincerely,

Smallbones(smalltalk) 17:22, 7 December 2022 (UTC)

This is a company that has had a rapid decline less than a month ago. I don’t think we should be using the past tense yet. The new CEO John J. Ray III is currently getting the records together in order to return money to creditors. We should keep watch of the news over the next few months to see what changes. I would appreciate other input, especially by editors who often work in this subject area. Thriley (talk) 20:23, 7 December 2022 (UTC)
So Thriley is correct that FTX is Not Technically Dead Yet - chapter 11 is reorganisation in the hope of going back into business. Personally I think this corpse would have trouble making a go of being a shambling zombie, and these companies are dead and not coming back, and they should liquidate as soon as is feasible. But technically FTX exists, the Debtor is a group of FTX-related companies now operating as one unit, and is in a state of "is". "FTX is a bankrupt cryptocurrency exchange" is the sort of way I'd word it, fwiw.
This can get silly. Right now I'm writing up one of the Celsius bankruptcy hearings. That's also a shambling corpse with some spare change in the stiff's pockets. But Ch 11 means everyone is supposed to pretend the 99.999%-dead can walk again. So Celsius Network still exists and is a bankrupt cryptocurrency investment firm.
That Celsius has, and FTX is overwhelmingly likely to get, DoJ-appointed bankruptcy examiners asking questions like "so what is the list of crimes committed here?" and "how hard did they Ponzi?" doesn't affect this either.
(I've been learning so much about US bankruptcy law in the past six months!) - David Gerard (talk) 20:56, 7 December 2022 (UTC)
Thriley, @David Gerard: I think "FTX is a bankrupt cryptocurrency exchange" would work especially if we could add in "defunct" or "no longer operating" in there somewhere. Maybe "FTX is a no-longer-operating bankrupt cryptocurrency exchange." If I know anything about bankruptcy, that is true and the most important thing that anybody needs to know about the company. "defunct" would be better than "no-longer-operating" but most folk don't really know what it means "no longer functioning or existing". I have followed bankruptcies and scam firms for a long time - not so much professionally, as much as a general subject of interest. I don't like pulling out credentials on Wikipedia - it really is difficult to verify here and we're designed to ignore them any way. But I have a PhD in finance from a major US midwestern university, about 20 years teacing finance and investments, and I traded for about 4 years on the floor of a major US commodity futures exchange. That's just FWIW.
People here have a very simplified view of financial failure, aka insolvency, bankruptcy, forced reorganization, etc. I suppose almost everybody does, but it drives me crazy. It takes us months to recognize the effective death of a company when it usually is very clear what the big picture will be for scam companies. People take creditors arguing over how to divide up the remaining assets as signs of life. Think of the 2 thieves in "A Christmas Carol" arguing over how to divide the bed curtains while Scrooge is lying stiff and cold in the bed. Does the argument bring him alive? Nope, he's still dead as a door nail.
Smallbones(smalltalk) 23:59, 7 December 2022 (UTC)
lol, you just described the Celsius hearing we're just writing up. Fights to the death over who gets the tuppence in the pockets.
(The lawyers, The lawyers get the tuppence.) - David Gerard (talk) 01:03, 8 December 2022 (UTC)

@Red-tailed hawk: I think I paraphrased the content enough that copyvio is not an issue. I did include a large quote from the source text of all the jobs he had during his college years which may have pushed this over the edge from paraphrasing to violation. I had no intent of using the quote without attribution, that’s why I kept it in quotes. Thriley (talk) 13:34, 14 December 2022 (UTC)

@Red-tailed hawk: According to Earwig, a violation is unlikely, with 37.1% similarity to the Vermont Stage profile. If the quoted text of jobs Lange held during college is removed, I imagine it would be a much lower similarity. Please review if you can. I wanted to finish up this draft today. I'll give it a look. The revision that was flagged as copyvio was [9]. — Red-tailed hawk (nest) 19:24, 14 December 2022 (UTC)
Hey. I gave it another look over and tried to paraphrase a bit less closely. This wasn't really a copyright issue so long as the quote had been attributed (which was your intent), so I'm sorry for the long template notice being dropped here. — Red-tailed hawk (nest) 04:43, 15 December 2022 (UTC)

Thank you very much! I appreciate the help. Thriley (talk) 05:04, 15 December 2022 (UTC)
