That's because the Daily Mail is not a reliable source. A community discussion concluded that "Consensus has determined that the Daily Mail (including its online version, dailymail.co.uk) is generally unreliable, and its use as a reference is to be generally prohibited, especially when other more reliable sources exist." But, regardless of the Daily Mail saying that a retired appeal court judge has said the case is "arguable", it was rejected anyway, so it seems he was wrong.
