If you look at the log for this file, there was one previous file uploaded by Joelsmith. That was the one with the non-free license. The version by Pharmakon was declared public domain by the uploader. —howcheng {chat} 06:06, 18 December 2014 (UTC)[reply]

The result of the discussion was: Deleted - the choice of license was not the only problem (although if these jerseys are a derivative of jerseys that someone else drew, you do need to credit that person, not just make the licenses match). The issue was the copyrighted helmet logo.

  • The original 2008 image had no verifiaction of the PD licence and I doubt the uploader actually took the formal military photo of Oppenheimer. The recent one has no licence and neither are sourced. At this stage I don't think the images should be split. The subject is dead so one non-free image could possibly be kept for identification purposes in the infobox of Charles Cuprill Oppenheimer. ww2censor (talk) 13:47, 22 December 2014 (UTC)[reply]

Being the owner of a copy of a photograph is not the same thing as being the owner of the copyright to that photograph. Additionally, there is no evidence that the photograph satisfies WP:NFCC#4, so fair use is no option. --Stefan2 (talk) 18:23, 7 January 2015 (UTC)[reply]
