Example of an artist's work being used under a claim of fair use. The artist has released a different image - File:Digital Montage Number 2 by Nick Gentry.jpg - under an acceptable license, as well as File:Still by Nick Gentry.jpg, which we're not even using in the article. (I have checked the OTRS ticket - the image I am nominating is NOT mentioned in the ticket and the licenses for the other two images are good.) I'm unclear why we need to use this image under a claim of fair use when we have two other good and freely licensed examples of his work. B (talk) 01:13, 24 March 2015 (UTC)[reply]

This image is an example of Dimitar Lukanov's work. We have a boatload of (better) photos that the artist himself has donated under acceptable licenses. I don't see a reason that we also need to use this one under a claim of fair use. B (talk) 01:19, 24 March 2015 (UTC)[reply]

Photo of Gloria Steinem and Dorothy Pitman Hughes used in article about the latter (who is living). The stated purpose is to illustrate "Dorothy Pitman Hughes prominence in the feminist movement and alliance with Gloria Steinem". That can be done with text - you don't need to prove it with a picture. The photo is in the National Portrait Gallery and there is a paragraph about it, which seems completely out of place in a biographical article and seems to serve no purpose other than to justify the photo's inclusion under our fair use policy. Scan of a newspaper article used in two biographical articles about people whose actions are discussed in the article. I'm unclear how having a picture of the article better helps understand either topic. (WP:NFCC#8) B (talk) 01:53, 24 March 2015 (UTC)[reply]

I believe this image contributes significantly to an understanding of both topics. First, it is useful because the subject sculpture is represented, and often, visual references can communicate more effectively than words, especially to show the range in size and subject matter. Second, because the artist is represented with his work, and being dead, that can not ever occur again. Third, direct quotes exist in the article. Fourth, this publication frequently deletes files of previous articles, leaving no other access to the article other than such a graphic. Fifth, it demonstrates the importance locally of the subject and the artist, to be given a full page spread with many photographs. Sixth, the editor, who prepared the image and added it to the articles, carefully chose images to accompany the articles to make both an appealing article for our readers. Seventh, it is one of few images that can tie the subjects of the two articles to one another. This image has stood the test of time in articles that see regular traffic from readers. Fulfilling the guidelines for images, and not being in violation of any fair use criteria, it should be retained. Deletion should not hinge on the taste of one editor when no other issue exists (for it merely is a difference between two editors, not regulations). I fail to find how that difference could be determined as a valid criteria for deletion and object strongly to the nomination for deletion. _ _ _ _ 83d40m (talk) 23:41, 27 March 2015 (UTC)[reply]

Meeting the criteria for fair use, the image was uploaded and inserted into the subject articles on 2011.09.19 and has been a feature of both articles continuously four years. _ _ _ _ 83d40m (talk) 14:35, 28 March 2015 (UTC)[reply]

  • Umm ... most of this is irrelevant to our fair use policy (an editor carefully choosing pictures, for example). Jim Gary is the sculptor and the article already has several other examples of his work, including File:Jim gary 83d40m stegosaurus illuminated 2p.jpg, which is very similar. Even if we did need a picture of this particular dinosaur, (1) you don't need the whole newspaper article to show one dinosaur and (2) using someone else's photo of it is inappropriate when it still exists and a WP:FREER photo could be taken. And you don't need a photo of the newspaper to prove that the coverage exists - you can simply cite it. And this image is also used in Kafi Benz and it's obviously even less appropriate for use there. I should also note that all of these photos of his work are derivative works and cannot be used as free content - none of them can stay on Commons (never mind, I see they are not actually on Commons) and they need a fair use rationale here. --B (talk) 04:39, 30 March 2015 (UTC)[reply]
