I have changed the tag to a PD-UK licence as the image was published in 1902 and the NPG's claim to own the copyright to an image published over 100 years ago is spurious. They own a copy of the image; this does not bestow copyright. The creator of the image died in 1914 and the copyright therefore expired 70 years after that date in 1984. If it’s PD in the UK but copyrighted in the US as current tag indicates, it's still non-free for our purposes. If it was published before 1923 it’s PD in the US as well, although the source doesn't specify whether 1902 is the date of creation, publication or both. It was first published in 1902 as that was the date of the election success it celebrated and that is the date inscribed on the mount. The photographer died in 1914 meaning it was published before 1923 so it is copyright free in both the UK and the USA Jack1956 (talk) 20:46, 30 November 2013 (UTC)[reply]
That the photographer died in 1914 is not evidence that the photo was published before 1923. Lots of photos are never published. However, this is obviously a published photo, based on the NPG's description. As it turned out that the photographer died before 1926, USA law typically only requires publication before 1989, although some care should be taken with subsisting copyrights for photos published after 1922. Although the moment is famous, the image itself is not discussed critically and not strictly necessary as in (e.g.) Tank Man. Readers can easily understand this article's topic without this image, failing WP:NFCC. —Justin (koavf)TCM 04:20, 29 November 2013 (UTC)[reply]

  • This is an AP photo (see watermark), WP:NFC#UUI#7 requires that the photo itself must be the subject of sourced commentary (not the event/incident depicted). The uploader of this image is blocked and was a serial copyright violator. Although EXIF information is present, there was a discussion some time ago regarding whether the uploader really did own the copyright. The balance of probability - mainly based on their contribution history & failure to understand policies - is that they do not. Sitush (talk) 15:05, 29 November 2013 (UTC)[reply]
