In Pakistan the copyright law is Copyright Ordinance 1962. In it government works are in public domain and one of the major exceptions to copyright (s13). Since PID is a govt organ (see the pid link says gov.pk) anything it releases is in the Public Domain. Secondly this photo was released freely to every person and all media and national dailies WITHOUT any legal licensing, because this is the norm in pakistan with non copyrighted work. — Preceding unsigned comment added by XCodeLyokoX (talk • contribs) 20:57, 4 August 2014 (UTC)[reply]

Well, if you look at "57. Certain acts not to be infringement of copyright" you will see that publishing the picture in wikipedia will not infringe copyright because of many reasons, it being a historic event, it being equivalent of a report on SSAP just to name a few. If i change its status to Copyrighted but fair usage, will it solve this issue? :/ I really don't know what to say. Copyright is very different in Pakistan here, I am uplading another photograph to commons and I had to chase down the photographer and he had never heard of a license agreement before. The things I CAN give you as evidence that this picture is absolutely free for use: 1)The name of the person who gave this photo and the name of the person who received the photo. 2) The name of the national dailies that printed APNS photos after the PRESS RELEASE (which is designed to be utilized by everyone and anyone for). — Preceding unsigned comment added by XCodeLyokoX (talk • contribs) 12:41, 5 August 2014 (UTC)[reply]
Two errors:
  1. Wikipedia is not hosted in Pakistan but in the United States, so what Pakistani law says is irrelevant. What Pakistani law says about copyright expiration is partially relevant, though.

Help me out here please. I know for a fact that the picture is utterly and completely free to use. It was given to the contestant who won the award and whose picture was taken. No license agreement came with the handing over of the picture because it is not the norm in pakistan. Apart from getting you guys an OTRS from a Government Agency (which i CANNOT do since i am a normal person) what can i do about it? Since the picture was given to the contestant to use anyway he deems necessary (its his picture after all) would an OTRS from this person suffice? If i am able to get an OTRS from the person who this picture was released to (the contestant) and change the type to copyrighted but fair use, will that suffice? I know this is in the public domain, but since i cant prove that if i put it up as copyrighted but fair use with the above mentioned permission, is that fine?XCodeLyokoX (talk) 21:54, 5 August 2014 (UTC)[reply]
