- Source has it licensed CC-BY-NC-SA, and there is not indication that the image is free. The OAC seems to have acquired copyright (noted here), meaning that PD is unlikely. — Crisco 1492 (talk) 01:37, 12 June 2012 (UTC)[reply]
- KEEP. This photo's copyright wasn't renewed per research of serial renewals by the Penn Library: [1]. The LA Daily News, a long-defunct newspaper, failed to renew any of their copyrights and thus all of their issues are now Public Domain. The UCLA archive simply put a blanket CC-NC license on all the contents of this donation, but in fact a fair bit of this archive is actually PD. --Pete Tillman (talk) 22:42, 15 June 2012 (UTC), original uploader[reply]

- Yesterday, it was tagged as {{PD-US}} and I tagged it as {{di-no source}}. Now changed to
{{self|cc-zero}}
with {{di-no source}} removed but the file name suggests that the photo was taken in 1908 so it is unlikely to be own work. PD if published before 1923, but there is no evidence of publication. This image is from the Chicago Daily News collection at the Library of Congress.[2] The photos in this collection were scanned by the Chicago History Museum, and in many cases I think that inclusion in this collection is the first time that these photos have been published—if they were published in the Chicago Daily News the description usually gives the date of publication (for an example see File:Belmont_Station_19070617.jpg). So, for those with no date of publication I have usually assumed that PD-US doesn't apply (or we cannot be sure whether or not it applies). The rights and reproductions page for this collection states: "The Chicago History Museum encourages use of these images to the extent permitted under the fair use clause of the 1976 Copyright Act, but it does ask that a credit line be included with each image used. Otherwise, permission must be requested and granted by the Chicago History Museum prior to use."—Jeremy (talk) 16:53, 12 June 2012 (UTC)[reply]

- Uploader claims (in good faith) to be the author but merely scanning and Photoshopping ("photographed using graphics") the original, a postcard or poster issued by an amateur theatre group, doesn't amount to authorship. Old Moonraker (talk) 14:46, 12 June 2012 (UTC)[reply]

- My name is Susane Lee and I created BOTH the photograph and all the graphics in the image in question. I created it for the Hudson Warehouse, and have given the Hudson Warehouse complete rights to use it as they please. And I also give the rights to anyone else who would like to use the image as it was created.
I hope this issue can be resolved. I am happy to discuss this matter privately with anyone and will happily give you my personal email and cell phone privately to do so.
But I want you to know that whoever cited the use of this image as a copyright violation was vandalizing my work. It has happened at least four times in the past month. Two were photographs of mine, one was a poster image of my art work, and one (this one involving the Merry Wives poster) was a poster image with both my photograph and art work. (Just as an FYI -- the written content on the page about this theater company, Hudson Warehouse, has been vandalized in the past.)
Quite frankly, it seems much easier on Wikipedia for someone to anonymously claim a copyright violation against your work -- and to do so repeatedly -- than it is for you to defend yourself and prove that a work is yours and that the person(s) using it have a right to do so. The fact that I am new to this process makes it even harder. I don't want the image deleted, but in all honesty having my work publicly flagged as "has an uncertain copyright status and may be deleted" is not much solace for me.

- This image was allowed because "UK Military insignia, originally Crown Copyright, Pre 1953 Crown Copyright images are now PD." As the Royal Irish Regiment was only formed in 1992 and new insignia were developed, I am struggling to see how the copyright is pre-1953. SchroCat (^ • @) 16:48, 12 June 2012 (UTC)[reply]
