Fair use rationale for Image:Dash.jpg[edit]

Image:Dash.jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. In addition to the boilerplate fair use template, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use.

Please go to the image description page and edit it to include a fair use rationale. Using one of the templates at Wikipedia:Fair use rationale guideline is an easy way to insure that your image is in compliance with Wikipedia policy, but remember that you must complete the template. Do not simply insert a blank template on an image page.

If there is other fair use media, consider checking that you have specified the fair use rationale on the other images used on this page. Note that any fair use images lacking such an explanation can be deleted one week after being tagged, as described on criteria for speedy deletion. If you have any questions please ask them at the Media copyright questions page. Thank you. BetacommandBot (talk) 20:59, 13 February 2008 (UTC)[reply]

SURELY, there's an available, public-domain portrait of Sam Dash somewhere. . . . --Michael K SmithTalk 14:57, 24 May 2015 (UTC)[reply]

RfC: Is the inclusion of the following photograph in this Wikipedia article permitted?[edit]

Samuel Dash attended Central High School in Philadelphia, and I recently stumbled upon a photograph of him in that high school's June 2, 1942 edition of the school's newspaper. I found a handful of these newspapers when looking through my grandfather's old things. The photograph is a black and white portrait of Samuel Dash in a suit along with a short article about him titled "Dash and ILSA Move To Aid in War Effort". The high school newspaper was called the "The Centralizer", and the photograph in question was in the Vol. XXXIX No. 10 June 2, 1942 edition of the newspaper. No copyright identifiers or indications are contained anywhere in the newspaper.

My question is, would it be permissible to include this photograph in the Samuel Dash article? Would this pose any copyright issues? And, would this pose any privacy related issues? Hmoon9 (talk) 03:03, 4 June 2023 (UTC)[reply]

@Hmoon9: This isn't at RfC level yet, which is for content disputes between multiple people that have had extensive discussion. You may want to ask this question at the Teahouse or over at Wikimedia Commons. JML1148 (talk | contribs) 04:34, 4 June 2023 (UTC)[reply]
Perhaps Wikipedia:Media copyright questions would be the first place to ask about this photo. (I agree with JML1148 that this doesn't belong under RfC, though I hope these are some useful suggestions that have been triggered by Yapperbot listing the RfC.) That is probably the better place to go; I did not know that that forum existed. JML1148 (talk | contribs) 05:20, 4 June 2023 (UTC)[reply]
I'm pulling the {{rfc}} tag per WP:RFCEND. There has been no WP:RFCBEFORE that I can see, and as noted above, it's really a WP:MCQ matter anyway. --Redrose64 🌹 (talk) 08:35, 4 June 2023 (UTC)[reply]

Hello @Hmoon9:, what a nice find! That should be safe to include on multiple grounds.

  • There are no privacy-related issues to using the photo; it was already used in another publication.
  • Until you can confirm that the photo is out of copyright, it's still fair use to include in this article.
  • It's unlikely the school paper filed for a copyright renewal, which was required until the 60s if you wanted (c) to last more than 28 years. So someone who was interested could confirm that those papers are now in the public domain.
