Rationale of fair use on Fantasy Black Channel[edit]

This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:

  • It illustrates an educational article specifically about the album which contains the song from which this sample was taken.
  • It enriches and illustrates points discussed in the text relating to instrumentation, production, and the history of music with regards to its genres.
  • It is a sample of no more than 18 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording or to recreate the original recording.
  • It is of a lower quality than the original recording.
  • It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
  • It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
  • It is uploaded on Wikipedia, a not-for-profit organisation.

Specific rationale[edit]

  1. Illustrates Late of the Pier's unorthodox arrangements and fusion of various genres.
  2. Demonstrates Erol Alkan's production aesthetic, i.e. his use of electronic studio effects to accompany and add to the live recorded versions of the songs. This crossover of dance and rock music was pointed out by band member and drummer Ross Dawson as the reason for the band choosing Alkan as the producer.
  3. Reviewed by Mike Diver of Drowned in Sound as having a similar bassline to Joy Division's song "Dead Souls".
