Rationale for fair use in The Basement Tapes[edit]

This is a copyrighted audio sample. However, it is believed that its usage on Wikipedia under a claim of fair use is justified because:

1. This sample of the song "Apple Suckling Tree" shows one example of the rootsy style of music Dylan and The Band played on this album. Songs on The Basement Tapes were drawn from multiple sources—the majority from several 1967 sessions by Dylan and The Band. Others were recorded later than this, and a number were recorded around 1975. This sample is representative of the 1967 period of songs, and, accompanied by its caption in the article, illustrates for the reader the different styles present on The Basement Tapes. The sample conveys this information in a way that a simple written description could not.
2. It is a sample from a much longer recording, and could not be used as a substitute for the original commercial recording.
3. It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
4. It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
