  • This image is claimed to be free by virtue of having been made by the state of Florida, but there is no reason given to support that this image was made by the state of Florida. It is a shot of four men on a golf course. The image is evidently currently displayed not by the state of Florida, but by the county of Sarasota. Even if the county had photographed the image (which is doubtful), the county of Sarasota does claim copyright on its works. Moonriddengirl (talk) 11:55, 11 May 2015 (UTC)[reply]
    • As stated in {{PD-FLGov}}, the template covers anything which is a work which was 'created by a government unit (including state, county, and municipal government agencies) of the U.S. state of Florida'. If the picture was created by the county of Sarasota, then it was created by a 'county government agency', which is explicitly listed as covered by the template. We are missing evidence that the picture was created by the county of Sarasota, though. Unless the uploader provides such evidence, we will have to assume that it was created by someone else. --Stefan2 (talk) 12:07, 11 May 2015 (UTC)[reply]
  • @Moonriddengirl and Stefan2: http://www.sarasotahistoryalive.com/people/thomas-reed-martin/ has the photo (top photo on the right) and says "Photo credits: Sarasota County History Center". I'm not clear, though, whether the "Sarasota County History Center" claims to be the author of the photo or is merely in possession of it. --B (talk) 13:10, 11 May 2015 (UTC)[reply]
    • A history centre might ask for photographs from the public and might therefore own copies of photographs from lots of different sources. Also, private family photos, which might end up at a history centre, were probably not published before they ended up at the history centre, making it a hell to track down the copyright status. --Stefan2 (talk) 22:44, 11 May 2015 (UTC)[reply]

    • Is this the right forum? If the files are PD in the US, then they are "free content". The reason to delete them is not because they are unfree, but, rather, because we don't want to accept images under these circumstances.       • In that discussion, it was decided that such files should be treated as 'unfree files' on English Wikipedia. If a file which is to be treated as an unfree file is listed as a free file, then PUF is the right forum for having this corrected. Also note that the statement 'This work is made by Iraqi citizens in Iraq. Iraq was not a participant in the Berne Convention or any other treaty on copyright with the United States. Therefore the work is public domain in the U.S.' isn't fully correct. There are additional publication requirements which need to be satisfied in order to be in the public domain in the United States: Iraq must be the country of first publication, the picture must have been published and the picture must not have been published in any Berne Convention or WIPO countries within 30 days after publication in Iraq. Thanks to Kernel Records Oy v. Timothy Z. Mosley p/k/a Timbaland, et al. (11th Cir. Sept. 14, 2012), it seems that this means that we need evidence that the picture was published in offline form in Iraq more than thirty days before the day on which it was first uploaded to the Internet.
