The uploader linked to http://sputn1k.com/kurtgrung/licence.html where there is a permission statement from someone claiming to be Kurt Grüng. However, the website belongs to a British company (according to a WHOIS lookup), whereas the photographer is a Norwegian. Furthermore, according to the article, this (note the different domain name) is the website of the photographer. Keep - The photo, which was taken before 1923, appears to be a personal snapshot and not a commercial photo, because half of its members are not professional musicians – it is unlikely that the photo was used in a commercial application. Since the photo has already been on Wikipedia for 9 years and has not generated a copyright complaint, it seems very unlikely that there is a copyright owner or requires a speedy deletion. Comment I reverted my own close of this deletion discussion since concerns were raised on my talk page regarding the arguments made above. - The problem is that although we do not know when the photograph was first published. User:James Carroll gives a very strong argument for deletion above: "The photo, [...], appears to be a personal snapshot and not a commercial photo". Personal snapshots are typically unpublished, and we do not have any evidence that this was published before the 1999 book listed on the file information page. Commons:COM:HIRTLE tells that the copyright to a photograph taken in 1918 but first published in 1999 expires on 1 January 2048 (or 70 years after the death of the photographer if that happens to be later). --Stefan2 (talk) 20:57, 8 March 2014 (UTC)[reply]

There is a problem with Stefan2's reasoning and perhaps the organization of Wiki photo rules. It is very likely that a personal photo like this from 1918 was never used commercially and never even had a copyright claimant. However as the decades passed since 1918 when the photo was taken, the author of the 1999 book probably assumed that the photo was in Public Domain and just went ahead and printed that photo in their book, realizing that there would be no legal consequences. In such a case Stefan2 would be incorrect in asserting that a copyright violation had occurred, since all involved with the personal photo throughout the years considered it to be Public Domain. For historic personal photos that are this old, it would be more realistic for Wikipedia to view them as being without a copyright owner, unless some evidence exists to the contrary. The fact that this photo was published on Wikipedia for 9 years without a complaint further suggests that there is no copyright claimant. This might be a situation where we can not see the forest because all the trees keep getting in the way.James Carroll (talk) 21:44, 8 March 2014 (UTC)[reply]
- If the 1999 book was the earliest publication, then how could that one possibly be a copyright violation? Where do you find old unpublished personal photographs? The answer to that question is simple: you find old unpublished personal photographs in the homes of the heirs of the photographers. Whether or not the book publisher thought that the photograph was in the public domain does not matter; if he got the photograph from the photographer's heirs when asking for photographs for his book, this may imply an implicit permission to publish the book.

User:James Carroll questions why this was on Wikipedia for 9 years without any complaints. Well, there are plenty of old copyright violations all over the place. The copyright holder might not know that an image is here and might not know what the law says about copyright violation. See also some other possibilities in the list at Commons:COM:PRP. And many old personal photographs are discarded by the original photographers, and end up in swap-meets or end up in online collections of large public municipal libraries, who intend to preserve public access to these treasures. Weak keep. This is a cropped version of a larger version on Commons. The poses, quality and caption strongly suggest a publicity photo for the Cadillac Club, not a private snapshot. But that is not proof that the photo was in fact first published before 1923. The photographer may have lived a long life, and the author of the book could have obtained permission from him or his heirs to publish for the first time in 1999. On the other hand, WP:fair use seems to apply since we do not seem able to find a free equivalent and the grouping of these performers at that club at that time seems unique and historically relevant.
