- What issue specifically needs to be addressed? The creator of this image, Ed McDonald, died in February. He definitely wanted the image used for the Pipe Creek Sinkhole article, and I don't think that he would have objected to its use for any legitimate scientific or educational purpose or in other Wikipedia articles. -- Cuppysfriend (talk) 23:22, 17 October 2013 (UTC)
- The problem it is not enough to have permission to use it on Wikipedia, or even for legitimate scientific or educational purposes. Wikipedia requires that material be licensed such that it may be used by anyone, for any purpose, including commercial use. - We used the "CopyrightedFreeUseProvided" tag, which should be determinative. I added the additional comment because it was I and not the image creator who uploaded the file. - The problem is that the permission is insufficient. A proper permission needs to be obtained from the copyright holder. If the photographer is dead, the permission will have to come from the photographer's heir. - I'm checking the fair use criteria to see if this image qualifies for use in the Pipe Creek Sinkhole article; but I doubt that I can make a case for the fossil turtle image since the article is about the site itself and not about the fauna discovered there. -- Cuppysfriend (talk) 20:42, 21 October 2013 (UTC)

- No, they can't. The photo is of the site as it appeared ten years ago before most of the paleontological excavation was completed. It's in a commercial limestone quarry and either has been or is in the process of being obliterated now that the scientific work is done. - I propose modifying the explanation on "replaceability" to read: "No free equivalent image available. Making a new image is not possible because the appearance of the site has been altered by the paleontological excavation. Even if the artist died immediately after creating the cartoon, it won't be public domain until 2051. - I don't understand. How can the subject in the photo which I took be copyrighted when it is a display of various of toy trains at the park? These are layouts which aren't even copyrighted. - You can't always take photos of things in parks (see e.g. Korean War Veterans Memorial#United States postage stamp court case). Someone made the railway system. As we are talking about toys, it's not utilitarian either, see Commons:COM:TOYS. You can take photos of constructed buildings which are visible from public places (see s:United States Code/Title 17/Chapter 1/Section 120), but I don't know if this also applies to toy houses. --Stefan2 (talk) 13:01, 17 October 2013 (UTC)
- Keep - 1. In regard to Korean War Veterans Memorial#United States postage stamp court case - the picture in question is not of a Design and construction, Memorial, Troop statistics or United States postage stamp.
2. In regard to Commons:COM:TOYS. The toys in question do not have a visible trademark and the toys are barely distinguishable themsleves.
