- Right, let us see where this dragon stands on ground of copyright. I think

is ineligible since the dragon is not of simple design (I judge it would need a level of artistic skill to render the proportions and poise in such a clean manner). Is it a derivative of a much older and out of copyright design? Bearing no similarity in pose with the one on the flag, this dragon is also different from that of the National Welsh Football Team's badge; the overall proportions and the posture of its legs are different enough to be original. Therefore, I doubt it is a copy of an older dragon; it likely deserves its own copyright. Wales seems to be covered under United Kingdom's Copyright Laws and I doubt the FAW can be considered part of UK's government, so we have to look on private grounds, where it is 70 years pma for known authorship. If it is of anonymous (or corporate) authorship, then we have 70 years after first publication to contend with. In this case, assuming this (1950) is the first publication, the dragon is copyrighted until 2021. If one wishes to avoid the URAA mess, then unless the first publication is 1925 or earlier, tis dragon shalt be in the realms of copyright protection. - From that link, the earliest year I can determine for the year of copyright of dragon in the match programme is 1938; it is a "cleaner" version (derivative) of the dragon on this cap, the year is taken from its embroidery. If that is the first publication, then it would be PD in Wales, but its copyright in the US would have been restored by the URAA, especially since it is unlikely there are no reliance parties (people who were using the item) in the US before 1996. I fail to see how any fair-use rationale would apply to this being used on the Hywel Davies article. - Disagree. This is a personally made rendering and is the only image on the page of the subject item which is neither a screen capture nor a photo of toys. Copyright restricts the expression of an idea, but not the idea itself. As such my use of the idea of the devices itself, for demonstrative and commentary purposes, free of profit, is fair use, and the rendering, which is wholly my work, is released to the public domain. (To explain, my preparation of a derived work, if it were not itself covered under fair use, would be a copyright violation. However, it is covered under fair use. The image I created from that derived work is, thus, wholly my work (if it were used for a non-fair use purpose it would retroactively cause the original derivation (the 3D models) to cease to be fair use and thus cause the rendering itself to inherit that status) Dodger (talk) 22:49, 4 July 2010 (UTC)[reply]
- Adding this: The first work (the 3D models) is is for nonprofit educational and identification purposes. The copyrighted work is a series of stories, of which the existence of Sonic Screwdrivers only represents a small portion and the screwdrivers are not, in themselves, repsentative of the nature of the stories (i.e., they are props). The portion used (the general appearance of sonic screwdrivers) is an immeasurably small portion of the original work (45 years of stories, several decades of which didn't even feature sonic scrwdrivers as props), and the only possible effect of this work upon the potential market of Doctor Who or licensed toys derived from Doctor Who would be to increase awareness and interest. Moreover this work is transformative, changing the use purpose (identification and illustration rather than as a prop or story element), changing the media (rendered 3D animation rather than sculpted prop), and somewhat interprative ("making up" the handle of the 2nd Doctor's Sonic because it is never visible in the series). This meets all four criteria for Fair Use under US copyright law as well as the general guideline of hte work being in some way transformative. The picture stays.
