There is no evidence that David McClintock (subject in the photo) was the copyright holder, which is necessary for copyright to be held by Andrew D McClintock as his residuary legatee. — JJMC89(T·C) 05:39, 6 October 2019 (UTC)[reply]

Permission from Hugh McClintock does not specify the CC BY-SA 3.0 license and was just "to be used in this Wikipedia entry". As the artist, Raymond Piper would be the copyright holder, not Hugh McClintock. — JJMC89(T·C) 05:45, 6 October 2019 (UTC)[reply]

  • For the moment I've struck my addition of the OTRS notice of permission as a clear issue, though the other cases I will be considering more fully before doing that. I'd advise running it through the FfD process rather than use of, F4 (as I'm not sure if the "clock" would restart, continue or already be viewed as used) Nosebagbear (talk) 14:00, 6 October 2019 (UTC)[reply]

Photo is claimed to by pd because it was published prior to 1924 - however no evidence of this is given, (the source is simply listed as "Photo Ship" and the author listed as "Royal Navy" - with no evidence that it is a Royal Navy photo (which would be Crown Copyright and hence expired, or when or where it was first published.
