The result of the discussion was: Deleted - there is far too much doubt about the ownership of the copyright. If this can be sorted out sometime in the future then the image can be restored - Peripitus (Talk)

The OTRS ticket shows a forwarded email from an anonymous representative of the Jamestown Foundation stating merely, "You may use them if you cite them." First of all, there is no evidence that the Jamestown Foundation is the copyright holder of the painting. Secondly, that email isn't even close to meeting our standards for a free license release. Now, speaking about copyright status of the images of Getman paintings, they now also appear on website of another nonprofit organization, although painting were previously published by Jamestown foundation [1], which means they had copyright for publishing. The images are also hosted on Flickr [2]... My very best wishes (talk) 15:26, 26 December 2013 (UTC)[reply]
Note that three or four of these images were initially placed on Commons by this user who posted the following quote from his email: You do have our permission. Just be sure to mention Jamestown as a source in the Wikipedia listing, and reference us with a web link to the paintings in your posting. Use this email as our special authorization. Thanks, Glen Howard, President, Jamestown Foundation, 6/14/2006. See here. Note that permission was about all images by Getman. My very best wishes (talk) 18:26, 26 December 2013 (UTC)[reply]

  • Delete There is no evidence that a foundation holds the copyright to the painting. Furthermore, the permission only applies to "you" (i.e. the uploader), and it is only possible to "use" the image, but not for example modify it. --Stefan2 (talk) 18:41, 26 December 2013 (UTC)[reply]

The copyright to a painting belongs to the painter's heirs, not to a foundation which has published the images. Also, a Wikipedia-only is insufficient; see {{db-f3}}. --Stefan2 (talk) 22:43, 27 December 2013 (UTC)[reply]

Appears (to me) to be a violation of WP:F7, a non-free use instance of an image owned by AFP, a commercial news agency. The image itself is not the subject of the article. I previously listed this with a speedy delete template, with no action. One user did contest the speedy deletion, that is available on the image's talk page.
