- Comment can you crop the flag first, and upload it, so that this can be deleted as being replicative of a free file? -- 70.24.248.246 (talk) 06:32, 31 December 2012 (UTC)[reply]

Ah I see. I'm not sure I noticed an option on the upload wizard for this. I'll try to reupload it, and this file should be deleted.Xyphoid (talk) 16:16, 31 December 2012 (UTC)[reply]
- Comment Despite the Flickr NC licence, the image might be PD, depending on whether, when and where it has been published. The photographer died 18 April 1943. Thincat (talk) 19:31, 1 January 2013 (UTC)[reply]
- The cut-off date for UK photographs is the author had to have died in 1942 (so it will be PD in a year). User:Zscout370 (Return Fire) 03:03, 2 January 2013 (UTC)[reply]
- Yes, but depending on the photo's UK and US publication history it might be PD in UK and US already or not PD in either for decades.[1][2] Thincat (talk) 11:20, 4 January 2013 (UTC)[reply]
- "If the work was created after 30 August 1989 and has a known author copyright expires 70 years after the death of the author. If the work was photograph with a known author taken before 30 June 1957 then copyright also expires 70 years after the death of the author." It was taken before that date because the author died in 1942, so the 70 year rule still applies. User:Zscout370 (Return Fire) 03:54, 5 January 2013 (UTC)[reply]

- Delete, along with its duplicate, File:He Senatus Academicus Room, South Street, St Andrews c. 1890.jpg. It's unfortunate, and it can be reuploaded in a year when it will be demonstrably public domain, but we simply cannot accept non-commercial licenses. Chick Bowen 23:22, 8 January 2013 (UTC)[reply]
- This is Wikipedia, not Commons. The copyright status in the UK does not matter to us, but in the UK, it enters the public domain next year (it does not matter whether it was published). For the US copyright status, there are four possible scenarios:
- The photo was published shortly after it was taken, or at least before 1923. In that case, the photo is in the public domain in the US as Commons:PD-1923.
- The photo remained in a drawer and was forgotten and later discovered and published at some point between 1923 and 1977 (inclusive). In that case, it enters the public domain in the US 95 years after it was published.
- The photo remained in a drawer and was forgotten and later discovered and published at some point between 1978 and 2002 (inclusive). In that case, it enters the public domain in the US on 1 January 2048.
- The photo remained in a drawer and was forgotten and not published at all before 2003. In that case, it enters the public domain in the US next year as Commons:Template:PD-US-unpublished.
- Is it likely that it was first published very long after it was taken? --Stefan2 (talk) 23:47, 8 January 2013 (UTC)[reply]
- Yes. It comes from the special collections of the university. There's no indication it was published prior to its posting on Flickr. Chick Bowen 01:57, 9 January 2013 (UTC)[reply]
