- Duh!thats why the summary information about the picture says "No information as far as copyright or owner of image is given (visibly) on the site. One can assume the image being upload is a free image, however, it would be safer to list the image as a non-free image, under the assumption of "Fair Use and Internet"." because is not shown the copyright of the pictures. Even if its a fan site you could use them under fair use, given the fact that is an screenshoot, or what, are you saying that people how takes an screenshoot of something owns the rights? No, of course no, the TV show and its related own them, that why I put this picture under "non-free tv screenshoot". Its all there, so stop trying to delete that image. - Delete. It's not a free image, first of all, so let's put that to bed. It's a screenshot of a copyrighted TV show, ergo it is copyrighted. The next test it must pass, then, is whether it adds anything significant that a free image couldn't possibly provide (WP:NFCC). The answer is very clearly no. - Delete - The image exif data on the full-sized original clearly states "THIS COPYRIGHTED IMAGE MUST NOT BE USED WITHOUT PERMISSION" and "Mandatory Credit: Photo By REX FEATURES BRITNEY SPEARS BRITNEY SPEARS IN PARIS, FRANCE - 2000". - Delete. Everyone, including the uploader, agrees that the image is copyrighted. However, the use of non-free photographs of living persons on Wikipedia is strictly limited, and unfortunately just because an editor thinks that a non-free image of a living person would make an article look better is not a sufficient reason for using it. The non-free content criteria must be complied with. - Lets try this one more time. Image clearly meets: Wikipedia:Non-free use rationale guideline. No free equivalent, that would serve the same encyclopedic purpose is available, could be created or is likely to ever become available as the subject is incarcerated and accused of murdering six people.[1] Subject has also confessed murdering these people to his friend[2] so it is very, very unlikely indeed that he is ever getting out of jail. - Would tag "replaceable" but it's a little more complicated. The image is used in two articles. One is to identify the actress, which is unnecessary as she is still alive. The other use is to illustrate a subsection of The Electric Company (1971 TV series), but the rationale in either use is quite unclear. - Keep I think. Fair-use rationale for this non-free image is legitimate enough for its use in The Electric Company (1971 TV series), as the image is likely non-replaceable. Its fair-use rationale for its use in the actress's article is invalid because the actress is living. However, I think the validity of the fair-use rationale in the first case cancels out the lack of a legitimate one in the second one, allowing the image to be kept. Technically, a free alternative could be created but because of Bulger's fugitive status, that would be highly implausible. For all intensive purposes, this is not replaceable. I also think this meets WP:NFCC#8, as the image can conceivably enhance a reader's understanding of the subject. - Keep It is quite unreasonable to expect a free image of an incarcerated person to become available while they reside in a federal prison. I have gone to great lengths to find a free alternative, contacting Scrushy's company and attorney but have had no luck. As the image description page indicates, I also went as far as to file a Freedom of Information Act request for the USDOJ's mug shot, but I was turned down. The letter I received claimed that personally identifiable information (including images) will not be released without the authorization of the individual. This image does not remotely fail WP:NFCC#1, unless Peripitus believes the DOJ is going to allow somebody to enter a federal prison, snap a shot of Scrushy, and post it on Wikipedia. --auburnpilot talk 03:55, 14 November 2009 (UTC)[reply]
- Why do we need an image while he is incarcerated ? Why cannot we wait until he is released in not many years from now ? He is making (from what I can see) court appearances where it is possible to photograph him and it's not like he's in for life. I do appreciate the efforts you've gone to for an image, but (there always is one) we clearly could get a free image of him.....there is nothing in the policy that talks about now' - 04:54, 14 November 2009 (UTC)
