You only nominated it to try and further your argument about the Aundrea and Aubrey - main.jpg image after I pointed out this image. - The non-free image I have of Aubrey O'Day in her article is a screenshot of a defining moment for her within that show. Not only did fellow contestants and judges take her talent very seriously after that, but so did Sean Combs. More can also be added to back up that screenshot being perfectly valid within that article. It is not about an image of someone holding a microphone. It is not about helping us understand that she sang a song. It is about the fact that this was a key moment in O'Day's life. Can it be conveyed the same way or just as well without that image? You nominated it for the reason I stated above. You say that the text can be fully understood without the image? That can be said for most non-free images on Wikipedia. Such as the one of the kiss between fictional characters Reese and Zach Slater in the Reese Williams and Bianca Montgomery article. Can people not understand that he kissed her without that image? Of course they can. And yet that image, which has plenty of critical commentary about that moment, is perfectly valid within that article. What, are you going to go after that image also, since I uploaded it and wrote most of that article?
- The fact is...that moment of O'Day's life cannot be fully conveyed by text alone. Talking about something significant and then adding an image to go along with it can very well be the same as supplying an image that significantly improves the readers' understanding. That moment is in no way conveyed the same way without this image.
- In addition, this image was previously passed over as needing to be deleted, because the editor who saw it felt that it was valid to stay within the article but that another one I had in the article was not. - The image seems to be okay: it portrays an important event in Aubrey O'Day's life, and appears to add to the text rather than just decorating the article. I've seen the image plenty of times and never thought to have it deleted. If Flyer22 can provide better commentary that'll be helpful, but if not, I still think it'll be fine. - I explained above, with even an example of another image in a different article I have heavily contributed to. I cannot explain it too differently than I already have. In the same way that the image of Reese and Zach kissing adds to that article, though the text already conveys that Reese and Zach kissed, this one does as well. The reason that image is perfectly valid is because it is displaying a moment that the article significantly notes and which has likely engaged the reader in feeling that they should see what all the hoopla is about regarding that kiss. That image displays a moment that has significant commentary about it. And I can do the same with this image of O'Day. What I have done with the O'Day article by including the image of a defining moment in her life is no different than a lot of articles on Wikipedia that have been deemed good or featured when including such non-free images of important moments about a topic backed up by critical commentary. I can add more critical commentary about that moment in O'Day's life, and am in the process of doing so, which I feel will make that image even more justified in staying. It is as if I were to add an image of her first Making the Band audition instead, which there is a lot of critical commentary about (some of which is already in the article).

Or that displaying a kiss on television that has been talked about a lot in valid sources and what it looked like is more necessary to show than an image of a key point in someone's life singing? Also, even if I add more critical commentary to go along with this moment in O'Day's life, will you still feel that the image is better not used? - Well, I don't think it matters whether the subject is fictional or not - if the image itself isn't significant, then it fails NFCC#8. I haven't seen the image you're referencing, but if the only rationale is that "it depicts a significant moment", then it shouldn't stay. And you may be missing the point with "critical commentary" - you seem to be talking about critical commentary about the moment in the person's life, rather than the image itself.
- Here's a comparison - an image of Janet Jackson's "wardrobe malfunction" would be appropriate in Super Bowl XXXVIII halftime show controversy, since the image was at the center of the controversy. - Yes, yes. The image I am talking about above of the fictional characters Reese and Zach was subject to controversy. Well, the moment was subject to controversy, but it was the imagery that got people all riled up. In comparison, I can see how the imagery of O'Day singing "At Last" has been no big deal (if that is what you are trying to say).
- When I was saying that "it depicts a significant moment" backed up by critical commentary, I was going by what people here usually feel is a good rationale for a non-free image being used within an article. Such as when two fictional characters kiss for the first time and there is critical commentary about that or it is noted in the plot section beside the image. Stuff like that is usually allowed in articles on Wikipedia. Sort of like the significant moment of video game character Aerith Gainsborough dying. When she was killed, that moment was talked about a lot, by fans and critics, and there is an image in her article which shows her death. You see what I mean? I am just not seeing how including an image of O'Day in the way I have is all that different than something like that. But I do get your point about the imagery of O'Day singing "At Last" never being a big deal; it was more about her voice than the image. With the Reese and Zach kiss and the Aerith death, it was more about the imagery. That is what you mean, right?
- Even so, another example would be the Todd Manning artice. It is another article that I have contributed heavily to (basically created), and I really hope that no one reading this goes after any of the images in that article. But at that risk, that article has been through two (sort of three) Good Article nominations, and every editor has stated that all the images used in that article are well-placed and comply with Wikipedia's fair-use rationale, such as Roger Howarth being on a certain talk show back in 1993 (which was a big deal back then). One of the editors who reviewed the article is very well-versed in copyright issues and saw no problem with that image. And I was simply trying to see how having a non-free image of Howarth on a show, which is discussed, is that different than having a non-free image of O'Day singing on a show, which is also discussed. I mean, the imagery of Howarth on that show was probably no big deal, but that moment was. While the Todd Manning article still needs work, and I am finishing that up, I was assured that all the images in that article are okay for use.
- All in all, I get your point. I may be a little confused right now about all this, but I get your point. Although Augustus John died only 48 years ago the painting was done well over 70 years ago. It is dated 1924 because that is the date at which it was first shown at the Royal Academy. This painting is the most famous image of the writer Elizabeth Bibesco and a valuable psychological comparison with the photographic images on the page. - Maybe. This painting may or may not be copyrighted. When was it first sold? Does anyone know? Critically, was it ever put up for public sale before 1989? If so, it is almost certainly PD, since U.S. courts have held that paintings are "published" when they are either duplicated (with permission of the copyright holder) or put up for sale. Few (if any) historic paintings have prominent © notices, so (assuming there's not a © and year somewhere I'm not seeing) it would be PD if sold before 1989. The Painting of Elizabeth Bibesco was last sold at Christies in 1980. It was illustrated at that time in the auction catalogue. The last previous publication of the image was in the Los Angeles Times in 1954. It was first sold in 1926 and resold in 1938. From what Quadell says, it would therefore be considered public domain. It isn't a US painting, so I don't think the pre-1989 rule applies. It is only PD in the US if it was either published in the UK before 1923 ({{PD-US-1923-abroad}}) or if it was PD in the UK on 1st Jan 1996. I think the rules in this case are 70 years p.m.a in the UK (1961 + 70 => 1st Jan 2032) and publication + 95 in the US (1926 + 95 => 1st Jan 2022). U.S. Copyright Law is complicated enough, but when you throw in the intricacies of other countries' laws, it quickly becomes muddled.
