Jill Singer image

Might I inquire as to why you believe the current image to be replacable by a free image? Do you have one in your possession or are you just assuming that somebody else does? The current image is allowable, unless Jill Singer decides to contact Wikipedia personally and ask that it be removed. Gamer Junkie 07:55, 4 May 2007 (UTC)

George Negus/Dateline

The text you inserted mentions "If you believe this image is not replaceable, follow the instructions on the image page to dispute this assertion." yet nothing has been added to the image page referring to this. and I don't believe your comment "WP prohibits use of TV caps that feature living people/person - "not fair use" under WP:CSD#I7 guidelines" is correct. For the two articles this image is on, I believe this applies, "Fair use images such as movie or television screenshots, magazine covers, and the like, are not freely replaceable. Although it may be possible to find free images that depict the person, those images will not depict them in context such as, for instance, their appearances on television that are likely important to illustrate in the article on that purpose, for reasons beyond mere identification." which can be found here. TV captures of living people/persons on Wikipedia are strictly forbidden, because the individuals have not given permission for their images to be used in such a way. Is a stupid policy, but that is the WP policy, notice that if you look at US/Canadian TV presenters pages all their previous screencaptures have been removed due to "replaceable fair use" Strawbs77 06:36, 25 May 2007 (UTC)

I did look and as I thought this is not true. So I still feel you are not judging this correctly. See [1] and [2] Two similar images to the ones you have gone through and marked for deletion in a whole lot of articles and just those two do not support your claim that all screencaptures have been removed, and neither do I feel they should be. they do serve a purpose. Also it appears as if your claim in your edit summary has #7 Invalid fair-use claim as your reason? The tag does match the image so that also seems incorrect. Farsouth 09:08, 25 May 2007 (UTC)

By that logic, Strawbs, almost all pictures of living people would be "strictly forbidden" on Wikipedia. If I took a photograph of a singer at a concert, or a politician giving a speech, or a famous actor in the street (with or without their permission), they have not given permission for their images to be used on WIkipedia, but as the photographer am I not entitled to release the photo under the GFDL and place it on Wikipedia or Commons? If you're sure that there is such a strict prohibition on fair-use TV screenshots, please let us know the wording of the policy to which you refer, because myself and other editors are having no luck finding such a rule. --Canley 10:38, 25 May 2007 (UTC)

"Angr" writes - The problem is the images in question are not freely licensed, and Wikipedia policy does not allow nonfree images of living people, since it would be possible for freely licensed images of them to be made. They are considered "replaceable fair use" and are regularly deleted. Wikipedia does not use images by permission (since that permission does not extend to other, non-Wikipedia users), and policy is quite clear that images of living people must be freely licensed in almost all cases". A TV capture is not a free image. The Couric & Conan ones above also should be deleted Strawbs77 12:14, 25 May 2007 (UTC)

OK, that makes more sense... it's not about permission at all, it's about possible replacability with a free image. I agree with the spirit of what you're doing, but I think it's overstating it to say that it's "strictly forbidden". It's not a policy, and what Angr refers to is his interpretation of a guideline and an essay. --Canley 14:10, 25 May 2007 (UTC)

(Undent) Just adding to this old discussion... It's not fair use to use a television screenshot just so you can have a picture of a person. For example, you can't have a screenshot of George Negus presenting Dateline on the article about George Negus just to show what he looks like. The reason for this is because its a replaceable fair use image; someone could get a free use image of George Negus. But you are allowed to have a screenshot of George Negus presenting Dateline on the article about Dateline, because it is identifying the program and no free use alternative could exist. I'm also just adding to this old discussion-- just to say that the deletionist spirit shown by Strawbs77, Angr and Tntnnbltn and, for that matter, Jimbo Wales, is painfully unfortunate. This spirit has come to be through an unfounded fear of lawsuits that will never happen and a concern for re-usability primarily benefiting shady website operators using Wikipedia content to boost their Google and Yahoo ads hits. Wikipedia should have become a sumptuously illustrated compendium. Now it will be a study in the use of inferior images. Sad. JDG 18:41, 19 June 2007 (UTC) -- Oh, and Strawbs, plz see this JDG
