Copyrighted images[edit]

Hi GuySh! It appears that you have uploaded a number of copyrighted images, for example File:Oref 2.jpg, claiming them as your own work. However, they are not your original work and merely a reproduction. Hi GuySh. Firstly, thank you for your reply.
I will explain in short how copyright law works and what you should do if you want to upload such images.
1) Copyright law protects original works (art, photography, etc.) from being reproduced without authorization. A reproduction does not have to be on the same medium. So for example, if you photograph a copyrighted painting, you are still reproducing it, even though you created the photograph yourself. Same goes for logos and emblems. If you make a reproduction of a copyrighted image, you can say you did it (i.e. your work), but you can't say that it's your original work, therefore you cannot determine and/or change the copyright status.
2) Some copyrighted images are permitted on Wikipedia under fair use. You may upload copyrighted images to Wikipedia itself (not Wikimedia Commons). After you have uploaded such an image, you must use it in an article and specify a fair use rationale on the image page. The rationale must state why you must use a copyrighted image and cannot use a free image instead. Here is an example of this in action.

Thank you for an explanation. I'll try to argue. Your assumption is that IDF hat badges insignia are copyrighted. I don't think so:

1. They are not logos or emblems of organization. Simply metal insignia for identification.
2. I used images of these hat badges in my book. The book approved by IDF censorship. They don't have any problem with it.
3. By your rationale, only images from IDF sites could be used. I must say it seems illogical. What if I want to show hat badge which is not in use 40 years ? I can't make it's photo ?
4. Some images used in the article are just wrong. Here is an example This type of hat badge never existed. Or This one - not in use from 1991 (regardless of color which is wrong too).

Hi GuySh. The fact that these images are copyrighted is not up for argument, it's simply a fact. Please review the Berne Convention and Israeli copyright law if you are in doubt. In short: everything that's not non-copyrighted for one of several reasons—is copyrighted.
Secondly, on the contrary, images from the IDF site should not be used, unless they are especially relevant (and they are still copyrighted).
I think your argument stems from a fundamental misunderstanding of copyright laws (no offense). If you have specific questions about it, I will gladly explain. Also, if you free that any of the images in the article are incorrect, feel free to remove them.

P.S. Sometimes, after long believing that an IDF-related image is copyrighted, we find out that it isn't. This is because of the 50-year rule for photographs or government publications. Therefore, if you can prove the these images were first published before 1960, and provide a source where they were published, they can be uploaded as public domain (but great care needs to be taken when doing this). —Ynhockey (Talk) 14:57, 24 April 2011 (UTC)[reply]

The reason why you may be able to publish some images in books but not Wikimedia Commons is because Commons requires images to be free, i.e. reusable for any purpose (including commercial) without permission. By contrast, in a book you can specify certain terms for reuse or forbid it entirely. Therefore, if the State authorized the use of the images on Wikipedia, this does not actually mean that you can use them on Wikipedia (hard to understand, I know :) ).
In any case, in order to use the beret pin images, you should take the following steps:
1) Upload the image to Wikipedia (not Wikimedia Commons).
2) Put up a fair use rationale for the images for the specific article where you plan to use it. A fair use rationale is required for each article where you plan to use the image.
3) Use the image.

Speed Deletion Category:Amos Oz on the hebrew wikipedia[edit]

May I suggest that if you don't know hebrew, you should be very carefull when creating new categories. The name you chose (עריכת הדף) doesn't mean "Amos Oz". So it was deleted and I created the correct name instead. GuySh (talk) 11:05, 31 December 2017 (UTC)[reply]
