Native title may be made in any Australian jurisdiction, using State or Commonwealth laws. In Western Australia there is no State native title legislation, so native title claims are lodged as "native title determination applications" under the Native Title Act 1993 in the Western Australian Division of the Federal Court of Australia.

Western Australia is divided into six regions, each with its own Native Title Representative Body. They are:
