Guidelines for night vision equipment export outside of the USA

Night Vision products are regulated by the U.S. Department of Commerce and the U.S. Department of State, Office of Munitions Control.

In accordance with International Traffic in Arms (ITAR),Title 22, Code of Federal Regulations Part 120-130 and/or the Export Administration Regulations (EAR) U.S. Department of Commerce, export of optical sighting equipment and night vision equipment in particular is regulated by U.S. Department of State Office of Defense Trade Controls. It is, therefore, unlawful to export, transfer, or sell any hardware or technical data to any foreign party (person or company) in the United States or abroad without explicit licence or written approval of the U.S. Government when such is required. Such licence must be obtained from the department of U.S. government which has jurisdiction over the specific products and/or regions.

Resellers and /or end users must obtain a licence for export of restricted items and must meet requirements of all applicable laws, regulations, and administrative policies.[1]

Generations 3 and 4


Generation 3 night vision equipment cannot be exported outside of the United States without permit by U.S. Department of State, Office of Defense Trade Controls.

Generation 4 cannot be exported as of the time of writing of this article.

Individual states may have specials laws pertaining to use of night vision equipment. Each person must study those laws before using night vision equipment in any given state.
