Summary[edit]

This image, featuring Shmulik Kraus (b. 1935) in his youth, said to be from his personal archives, was uploaded to the Hebrew Wikipedia in 2013 and has been displaying in his article ever since.

In the image description, the uploader notes that copyrights for this image have expired in Israel, per section 38 of the 2007 Israeli copyright law. In short, it is PD in Israel, so it cannot violate US copyright law. Therefore, I contend that it more than meets this fair use criteria.

I'd like to make it crystal clear: it is not possible to infringe the copyright holder of this image, because no such copyright holder exists, again, by virtue of these copyrights having expired.
