Fair use in Culture of the People's Republic of China[edit]

1. It is a low resolution copy of a CD album cover.
2. It does not limit the copyright owner's rights to sell the CD album in any way.
3. It is used to depict the culture exclusive in the People's Republic of China.
4. It is used to describe Guoyue culture.

Fair use in Guoyue[edit]

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. It is a low resolution copy of a CD album cover.
2. It does not limit the copyright owner's rights to sell the CD album in any way.
3. Copies could not be used to make illegal copies of the album artwork on another CD.
4. The person on the image cover is also deceased.
5. This album in particular was one of the best selling album in mainland China.
