This photo is believed to qualify for fair use on the Eric Von Schmidt article for a number of reasons, namely:
- It is a photo of a (deceased) historically significant figure, as Von Schmidt was an extremely important person in the late '50s and early '60s folk scene, inspiring and mentoring the likes of Joan Baez and Bob Dylan.
- It is used solely for educational and illustrative purposes on this article - no Public Domain files exist of Schmidt.
- It is of lower resolution than the original, so as not to infringe on copyrights and the original commercial interests and intentions of the author and/or copyright holder.
